1. Scope of the General Terms and Conditions (GTC)

These General Terms and Conditions (GTC) apply to all orders and deliveries between Jonboy GmbH (hereinafter referred to as "Seller") and its customers (hereinafter referred to as "Customer") via the online shop www.jonboy.at.

3. Offer and Conclusion of Contract

3.1 Contracts are concluded in German.

3.2 The presentation of the products in the online shop does not constitute a legally binding offer but an invitation to place an order. Errors are excepted.

3.3 By clicking the "Place Order" button, the customer makes a binding order for the items in the shopping cart. Immediately after placing the order, the seller will send a confirmation of receipt of the order to the customer. The contract is concluded when the order is accepted by the seller through an order confirmation sent by email after receiving your order.

4. Prices and Shipping Costs

4.1 The stated prices are final prices and include the statutory VAT.

4.2 For sales to countries outside the EU, Austrian VAT is not applicable. However, local taxes and customs duties may apply.

4.3 In addition to the stated prices, shipping costs apply for orders. The shipping costs are indicated in the shopping cart system and on the order page.

5. Payment Terms

5.1 The customer can choose from the following payment methods: credit card payment (Visa, Mastercard, American Express), Apple Pay, EPS transfer, Google Pay, Klarna Invoice, Klarna Sofortüberweisung, Maestro, Shop Pay, Union Pay.

5.2 If the prepayment option is chosen, we will provide our bank details in the order confirmation and deliver the goods after receiving the payment.

6. Delivery Conditions

6.1 Delivery is made within Austria and the EU.

6.2 Delivery will be made immediately, but no later than 30 days. For pre-order processes, the delivery time may exceed 30 days—any deviations in delivery times will be indicated on the respective product page.

7. Retention of Title

The goods remain our property until full payment is received.

8. Right of Withdrawal and Withdrawal Policy

8.1 Consumers have a 30-day right of withdrawal. The withdrawal period begins on the day the customer takes possession of the goods.

8.2 The right of withdrawal does not apply to goods made to customer specifications or clearly tailored to personal needs.

8.3 To exercise the right of withdrawal, the seller (Jonboy GmbH, Austraße 36, +436604138630, jonboy@theaustriankiwi.com) must be informed of the customer's decision to withdraw from the contract via a clear declaration (e.g., a letter sent by post or email).

8.4 Consequences of Withdrawal: If the customer withdraws from this contract, the seller will refund all payments received, including delivery costs (excluding additional costs arising from choosing a different delivery method than the cheapest standard delivery offered by us), promptly and no later than fourteen days from the day on which the seller received the notification of withdrawal from this contract.

8.5 The goods must be returned or handed over to the seller immediately and in any case no later than fourteen days from the day the customer informed the seller of the withdrawal from this contract. The deadline is met if the goods are sent before the fourteen-day period has expired. The customer bears the cost of returning the goods. The customer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

10. Warranty and Liability

The statutory warranty provisions apply (withdrawal according to § 3 Consumer Protection Act).

11. Dispute Resolution

The seller is required by applicable law to inform customers about the existence of the European Online Dispute Resolution platform, which can be used to settle disputes without going to court. We would like to point out, however, that we are generally not willing to participate in dispute resolution procedures within the framework of the European Online Dispute Resolution platform.

12. Final Provisions

12.1 Austrian law applies to the exclusion of the UN Sales Convention.

12.2 Should individual provisions of these GTC be invalid or become invalid, the validity of the remaining provisions remains unaffected.
